According to a California appeals court, federal law does not
pre-empt state law where the licensing of medical marijuana is
concerned.

The counties of San Diego and San Bernardino argued that
issuing ID cards to eligible medical marijuana users, as
required by a 1996 state law, would violate the federal law.

However, the appeals court ruled that the ID cards are not a
"significant impediment" to the federal Controlled Substances
Act, as that law was designed to "combat recreational drug
use, not to regulate a state's medical practices."
